Sexual harassment is generally defined as any form of sexual discrimination that involves unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when: a. Submission to or rejection of such conduct is made either explicitly or implicitly a term or condition of a person's job, pay, or career; or b. Submission to or rejection of such conduct by a person is used as a basis for career or employment decision affecting this person; or c. Such conduct interferes with an individual's performance or creates an intimidating, hostile, or offensive environment. d. Any person who commits the above action or implicitly condones such action is engaging in sexual harassment. Further, those active-duty personnel who commit acts of sexual harassment are subject to criminal prosecution under the Uniform Code of Military Justice. Civilians may be terminated or awarded other disciplinary action for the same offenses. Make no mistake about sexual harassment. Many people think that off-color jokes or comments of a sexual nature are acceptable simply because there is no physical contact or intent to seek a sexual relationship. That is not the definition of sexual harassment, nor is it a defense to the charge of sexual harassment. Any conduct or comment of sexual nature designed to intimidate or demean anyone can be considered sexual harassment. On a more personal note, recent charges against members of the Tailhook Association who allegedly engaged in blatant and professional misconduct of a sexual nature. NIS and Navy IG are conducting investigations into this matter. Media coverage has been extremely embarrassing. It is everyone's responsibility to educate others on sexual harassment and to eliminate or report all incidents or harassment.
